Over the last year, we’ve seen a significant increase in the number of special education disputes, several of which led to due process petitions and Rule 51 complaints. This coincides with the Biden Administration’s renewed focus on the processing of special education complaints on the federal level. As the stakes heighten around the provision of special education services, the Unicameral continues to take actions that make this complex area of federal law more complicated in our state. This session will focus on what has, and what hasn’t, changed with respect to your obligations to provide special education services under state and federal law.
